Were you issued a Desk Appearance Ticket?

A Desk Appearance Ticket, commonly referred to as a DAT, is a written notice issued by the police that directs a person to appear in criminal court on a future date to respond to criminal charges. It is an alternative to being detained in custody immediately after arrest. While a DAT can make the legal process less disruptive for the accused, it is still a serious matter that requires legal attention.

While Desk Appearance Tickets are less disruptive than being detained, there are things you should know. First, a  DAT still counts as an arrest and will appear on your criminal record. Second, your must appear in court on the date specified because a failure to appear can result in a bench warrant being issued for your arrest and can negatively affect your case. Third, being issued a DAT does not mean the charges have been dropped. You are still being prosecuted and could face penalties including fines, probation, community service, or even jail time, depending on the offense and outcome of the case.

The legal consequences of a DAT can be serious. Consulting with an experienced criminal defense attorney before your court date is critical. An attorney can (1) review the charges and evidence, (2) advise you of your rights and options, (3) represent you in court, (4) work to minimize or eliminate criminal penalties, (5) help protect your record and future.
